General terms and conditions of sale

Article 1 - Purpose

The present conditions govern sales by Tentation, a simplified joint stock company with a variable capital of €1,000, whose headquarters are at 1 Place de l'Homme de Fer, 67000 Strasbourg, France, and which is registered with the Strasbourg Trade and Companies Register (RCS) with the number 881 842 611.

Article 2 - Prices

The prices of our products for orders within the European Union are indicated including all taxes (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs.

In case of an order outside the European Union, the customer is responsible for the transportation of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be applied. These charges are not the responsibility of Tentation. They shall be payable by the customer and are the customer's sole responsibility, both in terms of declarations and payments to the competent authorities and organisations in their country. Tentation advises to inquire about these issues with the local authorities.

Tentation reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price list in force at the time of validation of the order and subject to availability.

The products remain the property of Tentation until full payment of the price.

As soon as the customer physically possesses the ordered products, the risks of loss or damage of the products are transferred to him/her.

Article 3 – Orders

Orders are made exclusively on the tentation.land website.

Any order made on the tentation.land website implies agreement with the present General terms and conditions of sale. Any order confirmation implies the full and complete agreement of the customer to the present General terms and conditions of sale, without exception or reserve.

All the data provided and the recorded confirmation will be worth proof of the transaction.

The customer declares that he/she is fully aware of them.

The confirmation of the order will be considered as a signature and acceptance of the operations carried out.

A summary of the order information will be communicated via the customer's e-mail address when your order is confirmed.

Tentation reserves the right to cancel an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulties concerning the order received.

Article 4 - Payment

Validating the order implies the obligation of the customer to pay the indicated price.

Payment of purchases is made by credit card, PayPal or bank transfer. Additional payment options may be offered depending on the country and the amount of the transaction.

Article 5 - Withdrawal and return

In accordance with the European regulation, any customer located in the European Union has a withdrawal period of 14 days from the receipt of your products to exercise its right of withdrawal without having to justify reasons or pay a penalty.

Returns can only be made after a written request to the customer service. The return address is: Tentation / Gmonbox, 32-34 rue des tuileries, 67460 Souffelweyersheim, France.

Returns must be made in their original and complete state (with packaging, accessories, instructions, etc.). The order number and the customer's name must accompany the package. In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may nullify the right of withdrawal.

The customer is responsible for the costs of returning the goods.

In the event of exercising the right of withdrawal, Tentation will reimburse the total amount paid, within 14 days following the effective return and via the means of payment used by the customer at the time of the order.

Article 6 - Availability

All products are offered as long as they are visible on the Tentation website and within the limits of available stocks. For products not in stock, offers are valid subject to availability from our suppliers.

In case of unavailability of a product after placing your order, the customer will be informed by e-mail. The order will then be cancelled and refunded using the payment method used by the customer.

Article 7 - Delivery

The products are delivered to the delivery address indicated during the ordering process. Unless otherwise stated, the delivery is made at the foot of the building in the presence of the customer or a person authorised to receive the goods. If the recipient is absent, the parcel can be dropped off at a nearby delivery point for small packages (transportable by one person). The customer will then be notified.

The delivery time is indicated on the product sheet. It is an estimated time and is not guaranteed. However, in the event of undue delay, except in cases of force majeure and if the order is not being delivered, the customer may request the cancellation and reimbursement of the order.

Upon receiving the order, it is the customer's responsibility to check the state and conformity of the delivered products before signing the delivery slip. This check must concern the quality, quantities, and references of the products, as well as their conformity with the placed order.
In case of defects or non-conformity of the products, the customer must immediately report these anomalies on the delivery slip, accompanied by their signature, and inform Tentation within 24 hours with photos as proof. The customer has the right to refuse the delivery.
Signing the delivery slip without mentioning defects or non-conformity transfers the responsibility of the products to the customer. After this signature, Tentation will no longer be responsible for any damages or losses that may occur.
If defects are reported and confirmed by Tentation, it may offer the customer, depending on the possibilities and at its discretion, an exchange, a repair of the product, a commercial gesture, or a refund. Depending on the case, the return of the merchandise may be necessary. In this case, it will be at the expense of Tentation.

Article 8 - Guarantee

All our products benefit from the legal guarantee of conformity and the guarantee of hidden defects for a period of 2 years, as from the date of delivery. In case of non-conformity of a sold product, after exchange with the customer service, it can be returned, exchanged or refunded.

The products must be returned to us in the state in which you received them with all the components (accessories, packaging, instructions, etc.). Tentation will take care of the shipping.

Article 9 - Liability

All products offered conform to the French legislation in force. The responsibility of Tentation cannot be engaged in case of non-respect of the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you are about to order.

Furthermore, Tentation shall not be held responsible for any damage resulting from improper use of the product purchased.

Finally, Tentation cannot be held responsible for any inconvenience or damage inherent in the use of the Internet, in particular a break in service, an external intrusion or the presence of computer viruses.

Article 10 - Applicable law in the event of disputes

The present conditions of sale are subject to French law. Any dispute shall be referred to the French courts in Strasbourg.

Article 11 - Intellectual property

All the elements of Tentation website are and remain the exclusive intellectual property of Tentation. No one is authorised to reproduce, exploit, rebroadcast or use in any way whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple link or hypertext link is strictly forbidden without the express written consent of Tentation.

Article 12 - Personal data

We reserve the right to collect nominative information and personal data concerning the customer. This information is necessary for the management of your order, as well as for the improvement of the services and information sent.

It may also be transmitted to companies that contribute to this process, such as those responsible for the execution of services and orders for their management, execution, processing, payment and delivery.

This information and data is also kept for security purposes, in order to comply with legal and regulatory obligations.

In accordance with European regulations, the customer has the right to access, rectify and oppose personal information and data concerning him/her, directly on the website.
